House Rent Allowance — salary component exempt from income tax under Section 10(13A), available only in the old regime.
Definition
HRA is a salary component for employees who pay rent. It is exempt from income tax under Section 10(13A) up to the lower of: (1) actual HRA received, (2) 50% of basic + DA (40% in non-metro), (3) actual rent paid minus 10% of basic + DA.
Available only in the old tax regime. Requires actual rent payment to a non-spouse landlord. If rent exceeds ₹1 lakh per year, you must furnish landlord's PAN. Tenants paying over ₹50K/month must deduct 5% TDS under Section 194IB.
Formula
HRA Exemption = min(Actual HRA, 50%/40% Basic, Rent − 10% Basic)Example
Basic ₹50K, HRA ₹25K, Rent ₹30K, Delhi (metro). Limit 1 = ₹25K, Limit 2 = ₹25K (50% of basic), Limit 3 = ₹25K (₹30K − ₹5K). Exempt = ₹25K/month = ₹3L/year.
