Definition

'Title deed' in Indian practice is not one specific government-issued document but the collective set of registered documents that together prove ownership of a property — the chain of title. It starts from the 'mother deed' (the earliest available parent document showing how ownership originated, such as a government grant, partition, gift or old sale deed) and runs through every subsequent transfer down to the current owner's registered sale deed. Your registered sale deed today becomes part of the title deed chain for the next buyer tomorrow.

The distinction from a sale deed matters: a sale deed records one transaction, while title is the legal ownership that the whole unbroken chain of documents establishes. A gap or defect anywhere in the chain — a missing link deed, an unregistered transfer, an heir who never signed — can cloud the title even if the latest sale deed looks perfect.

There is no single portal that issues a 'title deed'. Establishing title means collecting the chain of registered deeds (certified copies are available from the jurisdictional Sub-Registrar's office or state registration portals), reading them alongside the Encumbrance Certificate, revenue/municipal records (patta, khata, mutation entries) and tax receipts, and having a property lawyer examine the set — typically covering 13-30 years — and issue a title opinion. Banks mandate this legal scrutiny before sanctioning a home loan, and they keep the original title deeds in custody until the loan is repaid (which is also how an equitable mortgage is created).

Pitfalls: India follows presumptive rather than conclusive land titling — registration records transactions, it does not guarantee title — so due diligence on the full chain is the buyer's burden. Do not treat revenue or tax documents (khata, patta, mutation entries, tax receipts) as title; they support possession and assessment but ownership rests on the registered deed chain. And always insist on seeing original deeds, since missing originals can signal an undisclosed mortgage.
